The Library and AFSCME Local 2477, AFSCME Local 2910 and CREA IFPTE Local 75 have met and bargained the content, impact and implementation of LCR 2025-8 Regarding Policies, Procedures, and Remedies to Implement the Americans with Disabilities Act. The Parties have met their obligations under the contract.

TELEWORK PILOT AGREEMENT LIBRARY OF CONGRESS / AFSCME 2910
The following constitutes an agreement between the Library of Congress and

1. Voluntary Participation
I hereby volunteer to participate in the Telework Pilot Program. I will adhere to the conditions herein and to applicable law, Library regulations, and Article 38 (Telework Pilot Program) of the AFSCME 2910 Collective Bargaining Agreement (CBA).2. Offsite Work Location

3.Official Duties
I agree to perform only official duties at the approved offsite work location.
4. Assignment of Work
I will meet with my supervisor to receive assignments and to review completed
work as necessary. I will complete all assigned work according to work procedures
approved by my supervisor.
5. Performance Evaluation
I understand that my evaluation will be based on the normal performance requirements
of my position, including success in carrying out work assignments at the
offsite work location, in accordance with Article 15 (Performance Evaluation)
of the AFSCME 2910 CBA.

The Library may alter the offsite work location cited above to require that on certain dates the employee will work at his/her official duty station (e.g. for training or other-mission-related reasons). The employee retains all rights provided for in Article 21 (Hours of Duty) of the Collective Bargaining Agreement between the Library and the Guild.
7. Time and Attendance
At the beginning of each day at the offsite work location, I will inform my
supervisor that I am beginning to work by sending an email message to that
effect. In addition, I will fill out a flexiregister at home and turn it in
to my supervisor each week. I will certify time and attendance each pay period
to show the hours worked at my offsite work location and will be otherwise
governed by Article 21 (Hours of Duty) of the AFSCME 2910 CBA.
8. Leave
I agree to follow established procedures for requesting and obtaining approval
of leave, including those rights provided for in Article 24 (Leave) of the
AFSCME 2910 CBA.
9. Overtime and Credit Hours
I understand that I will be compensated for overtime work only when it has
been approved in advance, in accordance with Article 22 (Overtime) of the
AFSCME 2910 CBA and further that overtime work without such approval will
not be compensated and may result in termination of my participation in the
Telework Pilot Program. I retain all rights provided for in Article 23 (Credit
Hours) of the AFSCME 2910 CBA.
10. Library Material, Equipment, and Supplies
I understand that if I use government-owned materials, equipment or supplies,
I will obtain written approval for their use and protect them in accordance
with appropriate Library of Congress regulations. I understand that I am responsible
for servicing and maintaining any of my own equipment used for telework purposes.
The Library will supply appropriate documentation for performing telework.
I will apply approved safeguards to protect Library records from unauthorized
disclosure or damage.
11. Liability
I understand that the Library will not be liable for damages to my personal
or real property during the course of performance of official duties or while
using government-owned equipment at my offsite work location, except to the
extent the Library is held liable by the Federal Tort Claims Act or claims
arising under the Military Personnel and Civilian Employees Claims Act.
12. Safety and Inspection
I understand that I am covered by the Federal Employees Compensation Act (FECA)
if injured in the course of actually performing official duties at the official
duty station or the offsite work location. Any accident or injury occurring
at the offsite work location must be brought to the immediate attention of
my supervisor. I agree to allow appropriate authorized representatives of
the Library to investigate and inspect the offsite work location to ensure
proper maintenance of government-owned property, to ensure conformance with
safety standards, or following any notification of an accident or injury.
Reasonable advanced notice will be given, at least forty-eight (48) hours.
13. Costs Associated with the Telework Pilot Program
I understand that the Library will not be responsible for any operating costs
that are associated with using my home as an offsite work location, e.g.,
home maintenance, insurance, or utilities. I understand that I do not relinquish
any entitlement to reimbursement for authorized expenses incurred while conducting
business for the Library, as provided for by statute and regulations, as well
as the AFSCME 2910 CBA.
14. Evaluation of Telework Pilot Program
I understand that I may be required to complete surveys and participate in
other activities designed to evaluate the Telework Pilot.
15. Termination of Participation in Telework Pilot Program
I understand that the Library may terminate my participation in the Telework
Pilot Program at any time for just cause, such as less than fully satisfactory
job performance or failure to adhere to the provisions of this Telework Pilot
Agreement. I will be given written advanced notice indicating the reason(s)
for ending my participation in the Telework Pilot Program.
I understand I may terminate participation in the Telework Pilot Program at
any time by providing written advanced notification to my supervisor.
